2019 Finish Line Bracket Challenge OFFICIAL RULES
FREE TO ENTER. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT IMPROVE CHANCES OF WINNING. THE FOLLOWING CONTEST IS INTENDED FOR VIEWING IN THE UNITED STATES AND DISTRICT OF COLUMBIA ONLY AND IS OPEN ONLY TO ELIGIBLE ENTRANTS (AS DESCRIBED IN THE RULES BELOW). VOID ELSEWHERE INCLUDING U.S. TERRITORIES AND WHEREVER PROHIBITED.
By participating in the Contest, you (as an “Entrant”) agree to be bound by these Official Rules and the decisions of the Sponsor pertaining to the Contest, which you further agree shall be final and binding in all matters pertaining to the Promotion.
DO NOT PARTICIPATE IN THE CONTEST IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW. DO NOT PARTICIPATE IN THE CONTEST IF YOU DO NOT AGREE TO THESE OFFICIAL RULES.
Promotion Name: The Finish Line Bracket Challenge (the “Contest”).
Contest Description: The objective of the Contest is to accumulate the most points by correctly selecting the “winning pick” for each of the sixty-three (63) match-ups associated with the Designated Tournament. From all eligible entries received, the Contest Winner will be determined based on his/her ability to accumulate the most points in this Contest during the Designated Tournament, as further described in these Official Rules.
Contest Dates: Contest registration begins at 7:00 pm EST on 3/17/2019 and ends at 12:00 pm EST on 3/21/2019 (the “Registration Period”). The Contest Winner will be selected on or about 4/9/2019 after the Designated Tournament is completed. Sponsor is the official time keeper for the Contest.
Designated Tournament: The 2019 NCAA Men’s Basketball Tournament taking place between 3/21/2019 and 4/8/2019, with the Semifinal & Championship games to be held in Minneapolis, Minnesota. This Contest is not endorsed by, associated with or sponsored by the National Collegiate Athletic Association (“NCAA”), its members or partners.
Who May Enter:
The Contest is open to members of the Finish Line Winner’s Circle Reward Program who are legal residents of the United States and District of Columbia (EXCLUDING RHODE ISLAND), are the age of majority in their place of residence as of date of entry, have a valid U.S. driver’s license or government issued ID, have access to an Internet connection and a valid email address and are registered members of ESPN.com.
Notwithstanding the foregoing, the following persons are not eligible to enter or win the Contest: (a) Employees, agents, officers and directors of The Finish Line USA, Inc. (“Sponsor”) and/or its parent, affiliated companies, subsidiaries, distributors and each of their respective advertising/promotion agencies and any and all other person or entity associated with the design or execution of this Contest; and (b) any of the foregoing’s immediate family members or household members, whether or not related (for purposes of this Contest, “immediate family members” means parents, in-laws, grandparents, siblings, step-siblings, children, step-children, grandchildren, step-grandchildren and each of their respective spouses, regardless of where they reside, and “household members” means persons who share the same residence at least three (3) months a year).
Each Entrant must submit an entry on his/her own behalf. Any entry submitted on behalf of another individual or using commercial subscription notification and/or entering services, or any entry using another person’s email address or name, will be disqualified and ineligible to participate or win any Prize. No mechanically reproduced or automated entries permitted. Use of any automated system to participate is prohibited and will result in disqualification and all entries submitted through such system will be deemed void.
In the event of a dispute as to the identity of the Entrant, an entry will be deemed made by the authorized account holder of the email address used to register and he/she must be eligible according to these Official Rules to be deemed an eligible Entrant for the Contest (for purposes of this Contest, the “authorized email account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address). Any Entrant may be requested to provide Sponsor with proof that such Entrant is the authorized account holder of the email account associated with the entry..
How to Enter (Completing Your Bracket):
To enter, a participant must be a registered member of ESPN.com. This Contest is not endorsed by, associated with or sponsored by the ESPN or ESPN.com or any of its members or partners. Registration is free. To register, you may be asked to provide your name, birth date, gender, country of residence and/or email address (collectively, “User Information”) and to select a username and password.
Once you are a registered member of ESPN.com, during the Registration Period, visit the Contest webpage (set up for the Finish Line Challenge Group) at http://fantasy.espn.com/tournament-challenge-bracket/2019/en/group?redirect=tcmen%3A%2F%2Fx-callback-url%2FshowGroup%3FgroupID%3D2925550&ex_cid=tcmen2019_email&groupID=2925550&inviteuser=ezhDQUZCQTUzLUU5N0UtNEY0MC1BRkJBLTUzRTk3RUVGNDA2Q30%3D&invitesource=email (the “Contest Site”). Click on the ‘Create a Bracket Now!’ button and log in with your current EPSN.com username and password. Fully complete the online entry process by completing a bracket, which will require selecting a name for your bracket, picking the winners of each game in each round (a total of sixty-three (63) games) and completing tie-breaker related questions (if any). The play-in games on 3/19/2019 and 3/20/2019 are byes and not part of the Contest. In other words, selections of winners of these games will not be taken into consideration by Sponsor for purposes of determining Contest Winner. After having read and agreed to these Official Rules, click the submit button to submit your online entry (i.e., your completed bracket). Entrants must click the ‘Save Picks’ button on the Contest Site to save their bracket selections, cumulative score or updates. Any changes or entries made without clicking the ‘Save Picks’ will not be saved or recognized for this Contest. Return to the Contest Site to view entries, points and standings.
An Entrant is not required to elect any offered opt-in opportunities are not required to enter the Contest and accepting any opt-in prompts on ESPN.com or on the Contest Site will not improve your chances of winning. Entries will not be acknowledged. By submitting an entry, an Entrant represents and warrants that the Entry conforms to the requirements described in these Official Rules, including without limitation the Content Guidelines. Each entry is subject to, at any time, verification by Sponsor. Sponsor reserves the right to waive any entry requirements set forth in these Official Rules.
Eligible Entries: To be eligible, entries must be submitted on the Contest Site and received between 7:00 pm EST on 3/17/2019 and 12:00 pm EST on 3/21/2019. No entries submitted on the Contest Site or received after 12:00 pm EST on 3/21/2019 will be considered, regardless of the accuracy of the submitted bracket. To be eligible, an entry must be complete (including with a completed bracket for all sixty-three (63) games in the Designated Tournament) and include all required registration information. Any entry that is incomplete or submitted with an invalid email address will be disqualified. Only brackets entered on the Contest Site will be eligible to win. Limit one (1) entry per person and email address. If any Entrant submits more than one (1) entry, all entries submitted by that Entrant will be void and the Entrant will be disqualified. Any bracket not received by the required deadline for any reason including, but not limited to, transmission error, internet problems, equipment or website malfunction, internet traffic or errors caused by viruses or hackers will be disqualified. Sponsor is not responsible for any delays or difficulty in receipt an eligible Entrant’s entry that prevents full participation in the Contest. Entrants must use of ordinary and typical computer equipment, mobile phone equipment, Internet access and cellular networks when participating in the Contest. False, fraudulent or deceptive entries or acts shall render Entrants ineligible for the Prize. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Contest Site, has questionable eligibility or is otherwise ineligible to enter.
Content Guidelines:
As used in these Official Rules, “Content” refers to all information, photos, hashtags, captions, descriptions, comments or other content an Entrant submits in connection with an Entry. By submitting an entry, an Entrant represents and warrants that: (a) Entrant’s Content is Entrant’s original work; (b) Entrant’s Content has not been previously published; (c) Entrant’s Content has not been copied from others; (d) Entrant’s Content does not violate any rights of any other person or entity (including, but not limited to, copyrights, trademark rights, rights of privacy and publicity); (e) Entrant has permission to use the name or likeness of any person featured in Entrant’s Content; and (f) the publication of the Content will not infringe on the rights of any person or entity.
All Content must conform to the following guidelines:
- Content must be in a format acceptable to and comply with the terms of ESPN.com.
- Content must not have been generated by automated or like methods of submission.
- Content should not contain any personally identifiable information.
- Content must not include anything that is unlawful, obscene, offensive, provocative, sexually explicit, pornographic, violent, discriminatory or otherwise objectionable.
- Content must not promote alcohol, illegal drugs, tobacco or firearms/weapons (or use of any of the foregoing).
- Content must not promote any activities that are unlawful or appear to be unsafe or dangerous.
- Content must not defame, misrepresent or contain disparaging remarks about Sponsor or its products and services or other persons, entities or products.
- Content should not promote any particular political agenda or message.
- Content should not communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate.
Privacy: Personally identifiable information, including User Information, that is submitted by Entrants as part of this Contest will be used to administer the Contest, select the Contest Winner and fulfill Prize(s) and will be treated in accordance with the Sponsor’s Privacy Policy, accessible on its website at www.finishline.com. By entering into this Contest through ESPN.com, you are also submitting your personally identifiable information to ESPN, which is subject to the privacy policy and practices of ESPN applicable to your activity on ESPN.com. Sponsor is in no way responsible for any use of your personally identifiable information by ESPN or ESPN.com. By participating and submitting an entry, an Entrant agrees that Sponsor and its agents are authorized to contact Entrant via email, mail, phone or any other form of media to administer the Contest.
Scoring:
A correct pick in a given round (of the winner for a given game) is shown below:
- Round 2: 10 points per pick
- Round 3: 20 points per pick
- Round 4: 40 points per pick
- Round 5: 80 points per pick
- Round 6: 160 points per pick
- Championship: 320 points per pick
In the event a Designated Tournament match does not occur as scheduled (e.g., due to cancellation), no points will be awarded for that match. The decisions of the professional referees officiating the games in the Designated Tournament shall be final and binding regarding the outcome and scoring of the game.Tie-Breaker:
Ties among Entrants will be broken by the following determinations made in this order:
- predicting the correct National Championship winning team;
- predicting closest to the correct score of National Championship winning team; and
- predicting closest to the total cumulative points to be scored in the National Championship game on 4/8/2019.
An entry that does not win a tiebreaker is eliminated from the Contest and its Entrant will not be eligible to win the Contest.
Winner Selection: All Entrants with entries that won a tiebreaker will be entered into random drawing (“Select Entries”). One (1) Contest winner will be selected from a random drawing from the Select Entries (“Contest Winner”). The drawing to select the Contest Winner will be held on or around 4/9/2019. Odds of depend on the skill of each eligible Entrant, the number of eligible entries received and the number of Select Entries.
Winner Notification and Eligibility:
The potential Contest Winner will be notified by Sponsor by a message sent via ESPN.com and the Contest Site on or about 4/15/2019. A representative of Sponsor will make at least one (1) attempt to notify the potential Contest Winner. The potential Contest Winner will have twenty-four (24) hours to respond and claim the Prize. A POTENTIAL WINNING ENTRY AND CONTEST WINNER ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL. Sponsor shall solely determine any form of verification. An Entrant is not deemed the Contest Winner unless and until Entrant’s eligibility and the potential winning entry has been verified and Entrant has been notified that verification is complete.
To complete such verification, Sponsor will ask the potential Contest Winner for his/her email address and residential address and other pertinent information. The Contest Winner will be emailed or mailed a Declaration of Eligibility and Release of Liability/Publicity Form (“Declaration”) and Form W-9. The potential Contest Winner will be required to sign and return the Declaration and Form W-9 within fifteen (15) days of receiving the Declaration and Form W-9. The potential Contest Winner may be required to present a copy of a valid social security card and/or a valid driver’s license.
Failure to accept or properly claim any Prize in accordance with these Official Rules will result in forfeiture of the Prize. If the Prize is forfeited for any reason, the Contest Winner will not receive any other prize substitution or compensation, and the Prize will remain the property of Sponsor. If a Prize notification is returned as undeliverable, if Sponsor is unable to contact the potential Contest Winner for any reason within a reasonable time frame, if the Contest Winner is unwilling to accept the Prize, including on the Sponsor’s terms, or if the Contest Winner does not comply with Sponsor’s requirements as outlined above, including by not timely returning Declaration and Form W-9, the Contest Winner will be disqualified and the Prize may be, at the Sponsor’s sole discretion, awarded by Sponsor to an alternative potential Contest Winner, whose selection shall be consistent with these Official Rules.
Sponsor reserves the right to conduct a background check concerning any potential Contest Winner (and travel companion(s) of the potential Contest Winner, if any), including without limitation checking publicly available information contained in civil and criminal court records, police records and social media. To the extent necessary under law, a potential Contest Winner (and travel companion(s) of the potential Contest Winner, if any) shall authorize such background check and acknowledge that Sponsor has a legitimate need for such background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by any potential Contest Winner (and travel companion(s) of the potential Contest Winner, if any) and any potential Contest Winner shall be obligated to cooperate with any such efforts by Sponsor.
In the event the Contest Winner is later found to be in violation of these Official Rules, he/she will be required to forfeit the Prize or to reimburse Sponsor for the stated value of the Prize if such violation is discovered after the Contest Winner has claimed or otherwise used the Prize.
Prize: Sponsor will award one (1) prize (“Prize”) to an Entrant randomly selected from the pool of Select Entries. A maximum of one (1) Prize will be awarded. Award of the Prize is subject to verification of eligibility and compliance with these Official Rules. The Prize is a Five-Thousand Dollars ($5,000.00) shopping spree at a Finish Line store accompanied by NBA player, Victor Oladipo (the “Shopping Spree”). This Contest is not endorsed by, associated with or sponsored by the NBA, any NBA team or any of their members or partners. The total approximate value of the Prize is Five-Thousand Dollars ($5,000.00). The Prize does not include any other costs or associated expenses not identified in these Official Rules.
Prize Restrictions:
Contest Winner must be able to travel to the location of Sponsor’s choice during the date range of Sponsor’s choice. Inability of Contest Winner to travel to such location or travel on those dates will result in a forfeiture of the Prize. Sponsor may, at its sole discretion, assist Contest Winner in claiming the Prize and/or in traveling to such location during such dates, including by providing reasonable airfare and lodging, but any such additional assistance provided by Sponsor shall not be deemed part of or included in the Prize. The Shopping Spree will occur at such location and during such date range solely determined by Sponsor. Participation by Victor Oladipo in the Shopping Spree is subject to his schedule and availability. Sponsor is not responsible for any Contest Winner’s inability to claim the Prize, inability or unavailability to participate in the Shopping Spree or Victor Oladipo’s unavailability to participate in the Shopping Spree.
No cash redemption or prize substitution is allowed. No assignment, transfer or substitution of the Prize will be permitted except by Sponsor, who reserves the right to substitute a Prize of equal or greater value. By accepting a Prize, a Winner agrees to release and hold the Released Parties, which includes the Sponsor, harmless against any and all claims, damages, losses, expenses and liability for any injury or damage caused, or claimed to be caused, by the acceptance or use of any Prize.
The Contest Winner is solely responsible for filing all required tax forms and returns and all federal, state and local taxes and other fees associated with Prize receipt and use. The Contest Winner will be issued an IRS Form 1099 reflecting the actual value of the Prize won.
Publicity: Materials and information submitted by Entrants for the Contest become the sole property of Sponsor and will not be returned. Except where prohibited by law, all Entrants, including the Contest Winner, agree that Sponsor has the right to use an Entrant’s or the Contest Winner’s, as the case may be, name, likeness, voice, photograph, opinions and/or other information, provided by the Entrant or Content Winner, as the case may be, for commercial or non-commercial purposes, including advertising and promotional purposes relating to the Contest, in any and all media now known or hereafter known worldwide, including but not limited to Sponsor’s website (www.finishline.com) and accounts on various social media sites (such as Instagram, YouTube or Facebook), in perpetuity without additional payment, compensation, consideration, notice or approval to Entrant or the Contest Winner.
Contest Changes:
Sponsor reserves the right, in its sole discretion, to (a) change the Contest in its sole discretion at any time without liability to Entrants or third parties, including if and when Sponsor becomes aware of any circumstances or occurrence which would materially affect the Contest’s administration, security, fairness, integrity or proper conduct; (b) disqualify any Entrant or Contest Winner whose conduct is contrary to the spirit and intention of the Contest and these Official Rules or for any other reason Sponsor deems appropriate and to declare as void any applicable Entry or Entries; or (c) modify, cancel or suspend the Contest or any part of it at any stage for any reason, including circumstances beyond Sponsor’s reasonable control.
Without limiting the foregoing, (a) if the Designated Tournament is delayed, rescheduled, postponed or cancelled, Sponsor reserves the right, but assumes no obligation, to cancel or modify the Contest and shall not be required to award any Prize; and (b) if the Sponsor elects to modify, cancel or suspend the Contest for reasons which may include, without limitation, unauthorized intervention, fraud, technical failures or any other causes which may affect or corrupt the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right, but assumes no obligation, to void any and all Entries and judge and select the Contest Winner from among all eligible, non-suspect entries received up to the time of modification, cancellation or suspension of the Contest.
Without limiting the foregoing, Sponsor reserves the right to, at its sole discretion, disqualify any Entrant it finds, in its sole discretion, to be tampering with the entry process or the operation of the Contest. Sponsor may prohibit an Entrant from participating in the Contest or winning a Prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking or engaging in other unfair playing practices (including by the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants or Sponsor agents or representatives. By way of example, any attempt by an Entrant to obtain more than the permitted number of Entries by using multiple or different Instagram accounts will void all of that Entrant’s Entries and that Entrant may be disqualified.
GENERAL: The Contest is subject to all federal, state and local laws and regulations. By participating in the Contest, an Entrant acknowledges compliance with these Official Rules and all decisions of Sponsor, which are final in all matters relating to the Contest. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Entrants. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
DISCLAIMERS:
To the maximum extent permitted by applicable law, Sponsor is not responsible for (a) typographical or other errors in the offer or administration of the Contest, including but not limited to errors in advertising, these Official Rules, the selection and announcement of the Contest Winner, the distribution of any Prize or the cancellation of this Contest; (b) entries not received within the Registration Period or entries that are otherwise lost, late, damaged, delayed or incomplete; (c) any interrupted or unavailable network, server or other connections, miscommunications, failed telephone, computer hardware, software and other technical failures of any kind, including injury or damage to any person’s computer relating to or resulting from participating in the Contest; (d) unauthorized intervention, delayed, jumbled or garbled computer transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online whether caused by Internet users or any of the equipment or programming associated with or utilized in the Contest, regardless of cause that may limit a person’s ability to participate in the Contest.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: WITH RESPECT TO A PRIZE, SPONSOR MAKES NO REPRESENTATIONS AND GRANTS NO WARRANTIES, EXPRESS OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, BY STATUTE OR OTHERWISE, AND SPONSOR SPECIFICALLY DISCLAIMS ANY WARRANTIES, WHETHER WRITTEN OR ORAL OR EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE OR NONINFRINGEMENT.
RELEASE: To the maximum extent permitted by applicable law, by participating in the Contest, an Entrant agrees to waive and release, and hold all Released Parties harmless from, any and all claims of liability against Sponsor and its affiliates, parents and subsidiaries and its and their respective owners, officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) arising from any claims, damages, losses, expenses and liability of any kind (collectively, Losses”) arising from or otherwise related to the Contest, including without limitation any Losses arising from or otherwise related to an Entrant’s participation in the Contest or from the Contest Winner’s acceptance or use of any Prize awarded. The foregoing release shall not apply to any Losses arising from Sponsor’s own negligence or more culpable conduct or omissions.
FORCE MAJEURE: None of the Released Parties shall be liable to any Entrant or any other person for any action or inaction, including the failure to supply the Prize or any part thereof, caused by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control.
LIMITATION OF LIABILITY: To the maximum extent permitted by applicable law, in no event will any of the Released Parties be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of or otherwise relating to the Contest or the Prize, including without limitation any Losses arising from or otherwise related to an Entrant’s participation in the Contest or from the Contest Winner’s acceptance or use of any Prize awarded. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the foregoing limitation may not apply to an Entrant.
Gambling Prohibition: This Contest is strictly for entertainment purposes and may not be used in connection with any form of gambling.
DISPUTES; GOVERNING LAW: By entering or participating, Entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any Prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Indiana; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, and in no event will Entrant be entitled to received attorneys’ fees or other legal costs; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with the laws of the State of Indiana, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Indiana or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Indiana.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
